Product End User License Agreement

This Product End User License Agreement ("EULA") governs your use of any product purchased or downloaded from voxel.shop, which is the platform operated by Voxel Game Services LLC (“Company”, “us”, “our” or “Voxel). It forms part of the Purchase Agreement and is incorporated by reference into the main Terms of Service and our Privacy Policy.

By purchasing, downloading, or using any Product on voxel.shop, you agree to be bound by this EULA, as well as the Purchase Agreement and Terms of Service. If you do not agree, you must not purchase or use the Product. Eligibility criteria and other terms and conditions in the Purchase Agreement or Terms of Service will also apply to this EULA.

Voxel Game Services LLC grants you a limited, non-exclusive, non-transferable, revocable license to use the purchased Product for your personal, non-commercial use, and subject to the restrictions below.

Please note that in the event the Seller incorporates open-source or other third-party material into the Product, that material may be licensed to you under the terms of the license that accompanies such open-source or third-party material. Accordingly, you expressly agree to review any documentation provided by the Product’s creator and agree to such terms. Voxel makes no warranty

You May:

• Use the Product on your own servers or projects.
• Use the Product across multiple servers or projects only if you own or hold a significant ownership share (25% or greater) in each server or project where the Product is used.
• Make backup copies of the Product solely for your own use.
• Modify the product as necessary for your personal/ server use, provided the modifications do not violate this EULA.

You are strictly prohibited from:

• Reselling, redistributing, sharing, or transferring the Product (modified or unmodified) to any third party.
• Using the Product on servers or projects in which you have no ownership share.
• Removing or altering any copyright, trademark, or attribution notices.
• Reverse engineering, decompiling, or disassembling the Product.
• Using the Product for any commercial purpose beyond running it on your own servers or projects. (e.g., offering it as a hosted service to others for a fee, or collecting ad revenue from the distribution of the Product.)
• Using the Product in any way, including the creation of derivative works thereof, in order to build products to sell on competing platforms.
• Bypassing or removing any licensing, anti-piracy, or protection mechanisms.
• Making the Product available to other end-users as a standalone Product or in any way other than as incorporated into your server or projects.
• Using the product in any way that violates Minecraft's EULA or Mojang's commercial usage guidelines.
• Using the Product in any way that violates any third-party right, including any copyright, trademark, patent, trade secret, privacy right, or other intellectual property or proprietary right, or that is unlawful, harassing, abusive, tortious, threatening, harmful, obscene, defamatory, pornographic, or that promotes racism, bigotry, hatred, or physical harm of any kind.
• Uploading, transmitting, or distributing through a Product any viruses, worms, or other software intended to damage a computer system or harvest, collect, gather, or assemble information or data regarding other users without their consent.

We expressly reserve the right to investigate and/or take appropriate action against you in our sole discretion if you engage in any of these Prohibited Uses or otherwise create liability for us or any other person. Such action may include terminating this EULA and/or reporting you to law enforcement, as appropriate.

All Products remain the intellectual property of the original creator. This EULA grants you only a license to use the Product. You do not receive ownership or copyright of the Product. This license may be revoked at any time, including but not limited to in the event the original creator revokes the license of the Product to Voxel.

In the event you provide Voxel with any feedback, information, ideas, comments, reviews, or suggestions related to a Product (“Feedback”), you hereby assign to Voxel all rights in such Feedback and agree that Voxel will have a right to use and fully exploit such Feedback and related information in any manner it deems appropriate, including but not limited to sharing your reviews and information to advertise. You agree that you will not submit to Voxel any information you consider to be confidential or proprietary.

Some Products may be marked as "Archived." Archived Products are resources which have not been maintained to support the latest version of the game they are designed for, but are still available for purchase in case your server or project can make use of it. Archived Products are provided on an "as is" basis with no warranty or right of ongoing support or compatibility with newer versions of the game. You are granted the same limited license rights under this EULA to use the Archived Product, subject to all other terms and restrictions.

Support is provided solely by the Product creator in accordance with our Merchant Agreement. Voxel Game Services LLC is not responsible for providing support. Creators of non-archived premium resources must maintain a public support channel and respond to legitimate support requests in a timely manner (within 72 business hours). You acknowledge and agree that the Product’s creator may, at any time, modify, suspend, or discontinue the Product with or without notice to you, and that Voxel will not be liable to you or to any third party for such modification, suspension, or discontinuation. You further acknowledge and agree that neither Voxel nor the Product’s creator has any obligation to provide you with support or maintenance in connection with the Product.

Purchased Products may require certain minimum system or device requirements and/or only be accessible via third-party application marketplaces. You agree to make yourself aware of such requirements prior to purchasing a Product and/or be responsible for any noncompliance.

This license automatically terminates if you:

• Violate any term of this EULA, the Purchase Agreement, or the Terms of Service;
• Your voxel.shop account is terminated or banned for any reason.
• Voxel terminates your license due to a lapse in the license to Voxel.

PRODUCTS ARE PROVIDED “AS IS” WITHOUT ANY WARRANTIES OF ANY KIND. WE AND THE CREATOR DO NOT WARRANT THAT THE PRODUCT WILL BE ERROR-FREE, COMPATIBLE WITH ALL MINECRAFT VERSIONS, OR SUITABLE FOR YOUR SPECIFIC NEEDS. TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, COMPANY, ON ITS OWN BEHALF AND ON BEHALF OF ITS AFFILIATES AND ITS AND THEIR RESPECTIVE LICENSORS AND SERVICES PROVIDERS, EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, WITH RESPECT TO THE GAME, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT AND NON-INFRINGEMENT, AND WARRANTIES THAT MAY ARISE OUT OF COURSE OF DEALING, COURSE OF PERFORMANCE, USAGE, OR TRADE PRACTICE. WITHOUT LIMITATION TO THE FOREGOING, COMPANY PROVIDES NO WARRANTY OR UNDERTAKING, AND MAKES NO REPRESENTATION OF ANY KIND THAT THE GAME WILL MEET YOUR REQUIREMENTS, ACHIEVE ANY INTENDED RESULTS, BE COMPATIBLE, OR WORK WITH ANY OTHER SOFTWARE, GAMES, SYSTEMS, OR SERVICES, OPERATE WITHOUT INTERRUPTION, MEET ANY PERFORMANCE OR RELIABILITY STANDARDS, OR BE ERROR-FREE, ACCURATE, RELIABLE, FREE FROM HARMFUL CODE, COMPLETE, LEGAL, SAFE, AVAILABLE ON AN UNINTERRUPTED BASIS OR THAT ANY ERRORS OR DEFECTS CAN OR WILL BE CORRECTED.

To the fullest extent permitted by law, Voxel Game Services LLC and the Product creator shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Product. Our total liability shall not exceed the amount you paid for the specific Product.

• This EULA is governed by the laws of the State of Arizona.
• In the event of any conflict between this EULA and the main Terms of Service, or Purchase Agreement, the Terms of Service shall control.
• We may update this EULA from time to time. Continued use of a Product after updates constitutes acceptance.
• Products may be subject to U.S. export control laws and may be subject to export or import regulations in other countries. You agree not to export, reexport, or transfer, directly or indirectly, any U.S. technical data acquired from Company, or any products utilizing such data, in violation of the United States export laws or regulations.
• The communications between you and Company uses electronic means, whether you communicate with the Company through email or Product or platform functionality, or whether Company posts notices on any Product or communicates with you via email. For contractual purposes, you (a) consent to receive communications from Company in an electronic form; and (b) agree that all terms and conditions, agreements, notices, disclosures, and other communications that Company provides to you electronically satisfy any legal requirement that such communications would satisfy if it were to be in a hardcopy writing. The foregoing does not affect your non-waivable rights.
• The invalidity or unenforceability of any term or provision of this Agreement shall not affect the validity or enforceability of any other term or provision of this Agreement. If any term or provision of this Agreement is determined by a court of competent jurisdiction to be illegal or unenforceable under applicable law, such term or provision will be deemed deleted solely to the extent of such invalidity and solely with respect to the persons or circumstances as to which it has been held invalid or unenforceable, and the remainder of the provision shall be modified, rewritten, or otherwise interpreted by the court to include as much of its nature and scope as will render it enforceable, and all other provisions of this Agreement will continue in full force and effect.
• No failure to exercise, and no delay in exercising, on the part of either party, any right or any power provided by this EULA will operate as a waiver of said right or power, nor will any single or partial exercise of any right or power preclude further exercise of that or any other right. In the event of a conflict between this Agreement and any applicable purchase or other terms, the terms of this Agreement will govern.
• This EULA, together with the Terms of Service, Privacy Policy, Purchase Agreement, and other posted Voxel policies, constitutes the entire agreement between you and us regarding your use of Product sold on voxel.shop. Our failure to exercise or enforce any right or provision of this EULA will not operate as a waiver of such right or provision. The section titles in these Terms are for convenience only and have no legal or contractual effect. The word “including” means “including without limitation”. If any provision of these Terms is, for any reason, held to be invalid or unenforceable, the other provisions of these Terms will be unimpaired, and the invalid or unenforceable provision will be deemed modified so that it is valid and enforceable to the maximum extent permitted by law. Your relationship to Company is that of an independent contractor, and neither party is an agent or partner of the other. These Terms, and your rights and obligations herein, may not be assigned, subcontracted, delegated, or otherwise transferred by you without Company’s prior written consent, and any attempted assignment, subcontract, delegation, or transfer in violation of the foregoing will be null and void. Company may freely assign these Terms. The terms and conditions set forth in these Terms will be binding upon assignees.
